LEGAL TERMS AND CONDITIONS FOR GIVEAWAYS AND PROMOTIONS

1. ORGANIZING COMPANY

The company Manufacturas Vall Benaiges S.A., operating under the brand TIRALAHILACHA, with Tax ID A25018979 and registered office in Tàrrega (Spain), organizes promotional activities and giveaways (hereinafter, “the Promotion” or “the Giveaways”), carried out online through its official communication channels, including but not limited to its website, email newsletters, and social media accounts.

Unless expressly stated otherwise, these Legal Terms apply to all giveaways and promotions organized by Tiralahilacha.

2. PURPOSE AND DURATION

Each Promotion will have a specific purpose, participation period, and conditions, which will be clearly described in the corresponding announcement or post.
Once the indicated period expires, no further participation will be accepted.

3. ELIGIBILITY AND PARTICIPATION

Participation is free of charge and open to any natural person who meets the requirements stated in the specific announcement of each Promotion.

Participants must act in good faith and follow the instructions communicated for each giveaway (for example: subscribing, commenting, registering, or similar).
Each participant may only enter once per giveaway, unless otherwise specified.

Minors under 18 years of age are not allowed to participate.
Employees of Manufacturas Vall Benaiges S.A., collaborators, and their direct family members are excluded from participation.

4. WINNER SELECTION AND PRIZES

The number of winners, prize details, and selection method will be specified in each particular Promotion.
Unless otherwise stated, winners will be selected randomly or by objective criteria established in advance and published with the giveaway.

Prizes are personal and non-transferable, cannot be exchanged for cash, and must be redeemed under the terms indicated in each Promotion.
If the winner does not respond within the specified timeframe, the Organizer reserves the right to select an alternate winner or declare the prize void.

All prizes are subject to applicable tax regulations. Any tax obligations derived from the prize will be the sole responsibility of the winner.

5. DISQUALIFICATION AND FRAUD PREVENTION

The Organizer reserves the right to disqualify any participant who:

  • Manipulates or attempts to manipulate the Promotion,

  • Participates with false data or multiple identities, or

  • Engages in fraudulent, offensive, or unethical behavior.

Entries that violate these terms will be automatically excluded, and any awarded prizes may be revoked.

6. CONTENT AND CONDUCT

Comments, images, or actions that are offensive, discriminatory, defamatory, illegal, or infringe upon third-party rights are strictly prohibited.
The Organizer reserves the right to remove such entries and disqualify the participant.

Participants are responsible for ensuring that their submitted content does not infringe any third-party intellectual property or privacy rights.

7. LIABILITY DISCLAIMER

The Organizer shall not be held responsible for:

  • Technical failures, communication errors, or third-party actions affecting participation,

  • Loss, theft, or misuse of the prize after delivery, or

  • Force majeure or circumstances beyond its control that prevent the Promotion or the enjoyment of the prize.

If necessary, the Organizer may modify, postpone, or cancel the Promotion for justified reasons, ensuring transparency and fairness toward participants.

8. PERSONAL DATA PROTECTION

In compliance with the General Data Protection Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 on Data Protection and Digital Rights, participants authorize the processing of their personal data for the following purposes:

  • Managing participation in the Promotion,

  • Communicating and publishing the winners, and

  • Managing prize delivery and related communications.

The data controller is Manufacturas Vall Benaiges S.A.
Participants may exercise their rights of Access, Rectification, Deletion, Opposition, Limitation, Portability, and to not be subject to automated decisions by emailing info@tiralahilacha.com, including a copy of an identification document.

Data will be stored only for the duration necessary to manage the Promotion and comply with legal obligations.

9. MODIFICATIONS AND ACCEPTANCE

The Organizer reserves the right to update or modify these Legal Terms at any time, ensuring that participants’ fundamental rights are not affected.

Participation in any Promotion organized by Tiralahilacha implies full acceptance of these Legal Terms and of the specific conditions established for each campaign.

10. APPLICABLE LAW AND JURISDICTION

These Legal Terms are governed by Spanish law.
Any dispute shall be submitted to the competent courts of the participant’s place of residence, in accordance with consumer protection regulations.
